1. About this policy
This Privacy Policy explains how Seer Migration ("we", "us", "our") collects, uses, stores and discloses personal information. We handle personal information in line with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), and the confidentiality obligations in the Code of Conduct for registered migration agents.
By using this website or our services, you acknowledge this policy. It applies to clients, prospective clients, sponsors, visitors to this website, and other people whose information we handle.
2. Information we collect
We collect only the information reasonably necessary to provide our services. Depending on your matter, this may include:
- identity and contact details, such as your name, date of birth, address, phone number and email;
- passport, visa and travel history, including previous applications, refusals and cancellations;
- family and relationship information, including details of partners and dependants;
- education, employment, skills assessment and English test information;
- financial information needed for certain visas or sponsorships;
- for employers, business registration, financial and workforce information.
Sensitive information. Some visa applications require sensitive information, such as health information, criminal record information, or information about racial or ethnic origin or religious beliefs. We collect sensitive information only with your consent and only where it is reasonably necessary for your matter, or where the law requires or authorises it.
3. How we collect information
We usually collect information directly from you, through consultations, forms, emails, phone calls and documents you give us. With your consent, we may also collect information from third parties, such as your sponsor or employer, education providers, skills assessing authorities, translators, or the Department of Home Affairs.
If you give us information about another person, such as a family member, please make sure they know you have done so and that they can read this policy.
You may deal with us anonymously or using a pseudonym for general enquiries. For most migration services, this isn't practicable, as applications must be made in your legal name.
4. How we use your information
We use personal information to:
- assess your circumstances and give migration advice;
- prepare, lodge and manage applications, nominations, sponsorships and reviews;
- communicate with you and with authorities on your behalf;
- issue service agreements, fee estimates, invoices and receipts;
- meet our obligations under the Code of Conduct, including record-keeping;
- respond to complaints and meet other legal obligations;
- send you updates you have agreed to receive.
We don't sell personal information and we don't use it for any purpose unrelated to our services without your consent.
5. Disclosure of your information
We disclose personal information only as needed for your matter, with your consent, or as required or authorised by law. Recipients may include:
- the Department of Home Affairs and other Australian Government agencies;
- the Administrative Review Tribunal;
- state and territory nomination bodies, skills assessing authorities and education providers;
- your sponsor, employer or nominator, where your application involves them;
- the Office of the Migration Agents Registration Authority (OMARA), where required;
- service providers who support our practice, such as IT, cloud storage, email, accounting and translation providers, who must keep the information confidential.
Overseas disclosure. Some service providers, such as cloud platforms, may store data outside Australia. Where you are applying from overseas, we may also communicate with you, and people you nominate, in your country. We take reasonable steps to ensure overseas recipients handle personal information consistently with the APPs.
6. Storage and security
We store information electronically and, where necessary, in hard copy. We take reasonable steps to protect it from misuse, interference, loss, and unauthorised access, modification or disclosure. These steps include password-protected systems, multi-factor authentication where available, restricted access, and secure disposal.
Email and the internet are not completely secure. Please don't send identity documents through our website contact form; we will arrange a secure method if you engage us.
7. Retention
The Code of Conduct requires registered migration agents to keep client records for a set period after a matter closes (currently seven years). We keep records for at least that period, and longer if another law requires it. When information is no longer needed, we destroy or de-identify it securely.
8. Accessing and correcting your information
You can ask for access to the personal information we hold about you, or ask us to correct it, by contacting us using the details below. We will respond within a reasonable time, usually within 30 days. We may need to verify your identity first. If we refuse access or correction, we'll explain why in writing, as permitted by the APPs.
9. Direct marketing
We send marketing or newsletters only if you have agreed, and in line with the Spam Act 2003 (Cth). Every message includes a way to unsubscribe, and you can opt out at any time by contacting us.
10. Website, cookies and analytics
Our website stores a small preference in your browser to remember that you've dismissed the cookie notice. It also loads fonts from Google Fonts and, on the contact page, an embedded Google Map. These third-party services may collect technical information such as your IP address. See our Cookie Policy for details.
Information submitted through our enquiry form is sent from your own email app to our practice inbox.
11. Data breaches
If a data breach is likely to result in serious harm, we will assess it promptly and, where required under the Notifiable Data Breaches scheme, notify affected individuals and the Office of the Australian Information Commissioner (OAIC).
12. Questions and complaints
If you have a question or complaint about how we have handled your personal information, please contact us first. We will acknowledge your complaint and aim to respond within 30 days.
