Swati Kharoud is a registered migration agent (MARN XXXXXXX) and must comply with the Code of Conduct for registered migration agents, set out in the Migration Agents Regulations 1998. The Code sets minimum standards of professional and ethical behaviour. This page summarises what it means for you.
1. Registration and verification
In Australia, a person who gives immigration assistance for a fee must be a registered migration agent, unless they are an Australian legal practitioner or otherwise exempt. Registered agents are regulated by the Office of the Migration Agents Registration Authority (OMARA).
You can check Swati Kharoud's registration, MARN XXXXXXX, on the public register at mara.gov.au.
2. The Consumer Guide
OMARA publishes a Consumer Guide that explains your rights and what you can expect from a registered migration agent. We'll give you a copy before we start work. You can also find it on the OMARA website.
3. What we must do for you
- Act in your lawful interests, honestly and with integrity, care and diligence.
- Give you a written service agreement and fee estimate before starting work.
- Give you advice about whether your application has reasonable prospects of success.
- Keep you informed of the progress of your matter, and give you copies of documents lodged on your behalf.
- Keep your information confidential, except where you consent or the law requires disclosure.
- Hold fees paid in advance in a separate clients' account.
- Tell you about any actual or potential conflict of interest.
- Maintain professional knowledge through continuing professional development.
- Keep proper records of your matter for the required period.
- Deal with complaints fairly and promptly.
4. What we must not do
- Make false or misleading statements, including about our qualifications, experience or the likely outcome of an application.
- Guarantee the success of an application.
- Suggest a connection with, or influence over, the Department of Home Affairs or any government body.
- Lodge applications that are vexatious or grossly unfounded.
- Knowingly include false or misleading information in an application.
- Accept fees or benefits in a way that creates a conflict with your interests.
5. Your responsibilities
To help us act for you effectively, please give us complete, accurate and truthful information, tell us promptly about changes in your circumstances, respond to requests within the timeframes given, and pay fees as agreed. Giving false or misleading information to the Department can lead to refusal, cancellation and future bars on visas.
6. Concerns about our conduct
If you're concerned about our conduct, please tell us; see our Complaints Policy. You can also complain directly to OMARA at any time.
